Ten passengers on board a British Airways jet that crashed in London’s Heathrow Airport are suing the manufacturer of the aircraft. Documents filed before a court in Chicago, Illinois claim that Boeing were responsible for design flaws with the fuel system.

The Boeing 777 crash-landed early in 2008 after engine power was lost on final approach, coming down short of the runway. The aircraft was severely damaged. The United Kingdom’s Air Accidents Investigation Branch is still investigating, but interim reports have indicated that engine components became clogged with ice developing in the fuel.

The crew of the aircraft were praised for their handling of the emergency, avoiding the perimeter fence and nearby houses. None of the 136 passengers and 16 crew were killed but some of those suffered serious injuries, including broken bones and facial injuries. Some were left unable to fly and there were cases of Post Traumatic Stress Disorder.

The case, run by London firm Stewarts Law, is that Boeing are liable for the design of the engine component upon which the ice settled during the accident. “Our clients are not critical of BA and feel that the pilots performed heroically in guiding the aircraft down in exceptionally difficult circumstances,” said the partner in charge of the case, Stuart Dench. “However the two interim reports from the Air Accident Investigation Branch suggest design defects in the aircraft’s fuel system and in particular its limitations in the prevention of dangerous ice build-up. The passengers we represent are therefore prepared to take on Boeing in its home court in Chicago, which is undoubtedly the most appropriate jurisdiction for this case.”

Boeing may seek to have the case heard in London before the High Court. If successful, the claimants are estimated by the media to be able to claim US$1 million (£600,000).

A transgender woman attacked in Harlem, New York last week died on Thursday after being declared brain dead and taken off life support. Police are treating the death of Islan Nettles, 21, as a hate crime.

Nettles was walking with transgender friends early on August 17 when they met a group of men opposite a local police building. Police say a fight ensued after the men discovered the group was transgender and local man Paris Wilson, 20, was arrested at the scene.

Wilson was charged by prosecutors in Manhattan with assault and harassment. Prosecutors say more serious charges could be brought after police received allegations homophobic language was used, with a hate crimes team now investigating. The death has been ruled a homicide and a spokeswoman for the New York City medical examiner’s office said Nettles was killed by “blunt impact head injuries”.

The criminal complaint Wilson presently faces says a police officer found Nettles “unconscious on the ground with a swollen shut eye and blood on her face”. Wilson is accused of punching Nettles to the ground and then repeatedly hitting her while she lay there.

Nettles was interested in a fashion career, working as an intern for local fashion firm Ay’Medici. “Fashion became a definite decision for my life after my first show with my hand designed garments in highschool”, she wrote on LinkedIn, where she described herself as “anti-violence”. She has previously instructed fashion at Harlem Children’s Zone, undertaking studies at New York College of Technology and the Bread and Roses Integrated Arts High School.

Her mother, Dolores Nettles, told press Nettles and her friends were subject to transphobic insults. “They were called faggots, they were called he-shes, she-males, things of that nature,” she said.

Daniel L. Squadron of the New York State Senate said yesterday in a statement “Islan was 21 years old — 21 years old. And her life and future were stolen from her. Let’s be clear: intolerance, discrimination and hate have no place in New York or anywhere.” He called for the passage of a related bill he supports, the Gender Expression Non-Discrimination Act.

Wilson is presently free on bail, with a court hearing scheduled for October 4.

TV star Fern Britton is in talks with producers about appearing on BBC One show Strictly Come Dancing. She was best known for being co-presenter on ITV1’s This Morning — and is set to make her TV comeback on the hit show. She has been offered Brendan Cole as her dance partner.

One TV source has mentioned that there are many incentives for Fern to appear on the dancing show, including losing weight and also being offered a whole host of TV and magazine deals. The Strictly Come Dancing production team are keen to attract more viewers on this year’s series — especially as the programme will be going head-to-head with the new series of ITV1 hit singing show The X Factor, which appeals specifically to the 16–30 year old viewing market.

The BBC has yet to confirm or deny any contestants on Strictly Come Dancing.

The Interacademy Panel on International Issues (IAP), a global network of the world’s science academies, has released a statement urging parents and teachers to provide children with ‘the facts about the origin and evolution of life on Earth’. The statement is signed by 67 of the 92 member academies of the organisation, and notes that in some schools around the world, “testable theories” about evolution are being “concealed, denied or confused by theories not testable by science”.File:UreyMillerExperiment.jpeg

The statement presents four “evidence-based facts” that no scientific evidence has ever contradicted. These include the Earth being approximately 4.5 billion years old, life on Earth being at least 2.5 billion years old, and commonalities in all living organisms indicating a common primordial origin based on the process of photosynthetic organisms.

The news follows developments, mainly in the United States, where there is a concerted effort to include the teaching of ‘intelligent design‘ (ID), a theory which claims that complex biological features indicate that the presence of an intelligent ‘designer’ in schools. Opponents of this movement argue that it doesn’t qualify as a scientific theory, and is simply a disguise for creationist beliefs. In the US, where the separation of church and state is mandated by constitutional law, efforts to include ID in school syllabi were quashed by the courts, as the teaching of religion in schools is against the Establishment clause of the constitution of the United States. Despite this, George Bush has in the past remarked that he believes intelligent design should be taught in schools. The President has not shown any sign of plans to personally intervene in the legal debate however.

In December 2005, following legal case between the parents and the school district of Dover (Pennsylvania, USA), the judge decided that intelligent design was a religious view, and that it was unlawful to teach it as an alternative to evolution within the classroom. The IAP statement suggests that the science academies believe that ID is still being taught within some schools, however.

A Gallup poll conducted in May concluded that 46 percent of Americans believe that God created man in his present form sometime in the past 10,000 years, with 13 percent believing mankind evolved with no divine intervention and 36 percent saying that mankind developed over millions of years from lesser life forms, but with God guiding the process.

The IAP statement acknowledges limitations in current understanding, but argues that the process of science allows it to be open-ended and subject to correction and expansion as new understanding emerges.

The new book Game of Shadows: Barry Bonds, BALCO, and the Steroids Scandal that Rocked Professional Sports, by Mark Fainaru-Wada and Lance Williams of The San Francisco Chronicle, is being released today. The authors not only implicate professional baseball celebrity Barry Bonds in the use of performance-enhancing drugs, but also say Gary Sheffield received human growth hormone and testosterone from Greg Anderson, Bonds’s personal trainer.

The book goes on to claim that Jason Giambi also took performance-enhancing drugs from Anderson. Bonds continues to insist that he did not realize his trainer was giving him steriods. He claimed in his grand jury testimony that he thought he was receiving flaxseed oil and an arthritis salve. Sheffield’s response to the claims was quite simple: when asked if the allegations made against him were true, his response was “Nope.”

Despite the book’s accusations of Sheffield and Giambi, it centers around Bonds and the founder of the Bay Area Laboratory Co-Operative or BALCO, Victor Conte Jr. Conte is currently serving four months in prison for distribution of steriods and money laundering. It appears that the steroid controversy concerning Bonds will only intensify as he continues to march on towards the career home runs record, one of baseball’s most sacred records.

Warner Music Group first quarter earnings rose sharply mostly from growth in digital music sales offsetting falling CD sales. Warner Music sells digital music to several online services including Apple’s iTunes at wholesale. The company’s first-quarter revenue from digital music sales doubled to US$69 million, accounting for 7% of overall revenue. Madonna, Green Day, and James Blunt are signed to subsidiary labels of Warner.

Warner Music has undergone restructuring after being sold in 2004 by former parent company Time Warner. Cutting costs, exploiting current assets, and digital music has been the company’s focus since going public in May.
