Buffalo, New York —A proposed hotel that was supposed to be built at the corner of Elmwood and Forest Avenues in Buffalo, New York is apparently off the table. The former proposal was going to be called The Elmwood Village Hotel and would have consisted of 72 rooms and cost between $7 to $10 million American dollars to build.

Today several unknown individuals were seen removing a sign that was dedicated to the “Elmwood Village Gateway,” which signifies the beginning of the Elmwood Village at the formerly proposed project’s location.

Nearly an hour later the men replaced the sign with a different and unexpected sign: “For Sale: 5 commercial parcels and 1 carriage house, By: Owner.” Those 5 “parcels” are 1109-1121 Elmwood and 999 Forest Avenue, which is located in an illegal alley, according to the City of Buffalo, behind the 5 other properties on Elmwood. Hans Mobius owns all properties named in the sale.

Sam Savarino, CEO of Savarino Companies never owned the properties and has repeatadly told Wikinews in exclusive interviews that he still had a “contract to buy the properties” and on October 2, 2006 told Wikinews in an exclusive interview that he “extended” the “agreement to purchase the property[s] and will have it under contract for what we hope is a sufficient period of time.”

“He [Mobius] is undoubtedly concerned because he has lost some tenants and is a bit impatient. I think he has properly portrayed the situation,” said Savarino in an exclusive interview with Wikinews.

Savarino also says that there may be “legal issues” to work out now, before anything else can move forward, regarding the proposal.

“There are some legal complexities that must be sorted out before anything can happen there,” added Savarino.

The welcome sign was; however, not removed entirely. The sign was placed, facing the same direction of north, on the side of the Forest Plaza Art Gallery, a new art gallery located on the corner of Forest and Elmwood.

Nancy Pollina, owner of Don Apparel which was located at 1109 Elmwood, but closed on October 14, 2006 considers this a possible “victory” in regards to the lawsuit filed against the hotel to stop it from being built, alleging that several laws were broken, including not performing an Environmental Impact Study before the proposal was approved by the city, during its approval and the proposal was “rushed.” Patricia Morris, who operates Don Apparel with Pollina, Angeline Genovese and Evelyn Bencinich, owners of residences on Granger Place which abut the rear of the proposed site, Nina Freudenheim, a resident of nearby Penhurst Park, and Sandra Girage, the owner of a two-family residence on Forest Avenue less than a hundred feet from the proposed hotel’s sole entrance and exit driveway, were also plaintiffs in the lawsuit. They filed the suit with a lawyer representing them, Arthur J. Giacalone, on April 25, 2006 in New York State Supreme Court, but the case has never gone to a courtroom.

Giacalone believes that a press release issued in July regarding the project was nothing but a statement to “save face,” but that the placement of the for sale sign might be a way of convincing Savarino to speed up the sale of the properties.

“I thought all along that Savarino’s July press release might be no more than an effort to save face. But we have no way of knowing. Similarly, Mobius might have put the for-sale sign up in an attempt to pressure Savarino into closing the deal. There’s no way to tell,” said Giacalone in an exclusive interview with Wikinews.

In regards to the lawsuit, Giacalone thinks it may now be in “limbo.”

“The lawsuit still sits in limbo,” added Giacalone.

Ontario Lottery and Gaming Corporation instant scratch tickets under scrutiny

The CBC has raised new security concerns over the instant scratch tickets sold by the OLGC. CBC’s the fifth estate reported in a special investigation on October 25 the Ontario Lottery and Gaming Corporation’s (OLGC) tickets are not being given to lottery winners and are claimed more often by the retailers who sell them averaging at CAN$500,000.

The report investigated several aspects of the lottery retail trade, including a report that tickets were stolen by the clerks of convenience stores. One reported case involved a convenience store clerk who, after checking the ticket bought by a customer who brought suit, said he did not win.

Retailers appeared to win prizes more often than the general public. However it also appeared that retailers were a core audience of the lottery games and due to that, statistically, could be expected to win more than the general public. The study found that the retailers were winning about 2.5 times more than the general audience and spending almost twice as much on their tickets. Retailers spent CAN$23.30 over the past four weeks. The average person spends CAN$12.30.

“We are here to make sure that all of our players have confidence in our process,” OLG chief executive Duncan Brown said. “Lottery retailer means, in our broad definition, anybody that works for a lottery retailer or is related to a lottery retailer. That’s 140,000 people … in Ontario….What was missing from the fifth estate’s numbers was the frequency of play by the retailers.”

There were 30 complaints referring to the instant scratch tickets from 1999 to 2006. Only once ware charges laid by police. Nine cases had special investigations, winnings totaling at CAN$3,629.

Retailers could, in a process called “pin pricking,” attempt to uncover codes printed on the instant scratch tickets under a latex coating that show which card is the winner.

In the wake of earlier allegations, OLG devices were installed for anyone who wanted to check their own tickets, for security reasons.

“Any time someone connected with the OLG tries to claim a prize we conduct a higher level of investigation than what we would do with somebody who is not associated with OLG. And this includes looking at the tickets very carefully, especially in the case of scratch tickets,” Teresa Roncon, a spokeswoman for the OLGC said.

English actress Rachel Weisz thinks that Botox injections should be banned for all actors.

The 39-year-old actress, best known for her roles in the Mummy movie franchise and for her Academy Award-winning portrayal in The Constant Gardener, feels facial Botox injections leave actors less able to convey emotion and that it harms the acting industry as much as steroids harm athletes.

In an interview with UK’s Harper’s Bazaar, coming out next month, Weisz says, “It should be banned for actors, as steroids are for sportsmen,” she claims. “Acting is all about expression; why would you want to iron out a frown?”

Norway’s Conservative, Progress parties form minority government coalition

Following three weeks of talks, the leader of Høyre, Norway’s Conservative Party, Erna Solberg announced today that the Conservatives will form a minority government in a right-wing coalition with the Progress Party. The coalition will be the first time the Progress Party have been in power in the executive branch.

The coalition government plans to change policy on immigration and asylum, reduce inheritance tax, and reform provision of healthcare and pensions. The parties also agreed to not allow drilling for oil on Jan Mayen Island or in the Lofoten archipelago. The Norwegian Oil and Gas Association said the decision was “disappointing and undemocratic”.

Solberg said that she intends to continue working with other parties. The new government is due to take office on October 18. Solberg will replace the current Labor Party Prime Minister Jens Stoltenberg.

Man shot on London Underground unconnected to bombing, says Scotland Yard

Scotland Yard issued a statement that Jean Charles de Menezes, the 27-year-old Brazilian electrician shot to death yesterday by police in a London Underground station was “not connected” to Thursday’s bombings and called the incident “a tragedy”. A day earlier, the police commissioner said the man was “directly linked” to Thursday’s attacks.

The police statement said

“We are now satisfied that he was not connected with the incidents of Thursday 21st July 2005. For somebody to lose their life in such circumstances is a tragedy and one that the Metropolitan Police Service regrets.”

The man was followed when he left a flat that had been under surveillence. He did not obey instructions from police (not in uniform) as he ran onto a Tube train at the station. Eyewitnesses said he “was wearing a large coat, unusual for the time of year”, but didn’t seem to have “any guns or anything like that; I didn’t see him carrying anything. I didn’t even see a bag to be quite honest.”

Mark Whitby, apparently the closest eye witness said; “He half-tripped, was half-pushed to the floor. The policeman nearest to me had the black automatic pistol in his left hand, he held it down to the guy and unloaded five shots into him.”

The shooting is being investigated by the Metropolitan Police Service‘s Directorate of Professional Standards and the Independent Police Complaints Commission, which investigates all fatal police shootings.

Home Secretary Charles Clarke described the shooting of Mr Menezes as an “absolute tragedy” before going on to say “I hope [the family] understand the police were trying to do their very best under very difficult circumstances.”

Alex Pereira, a cousin of Mr Menezes, also living in the UK, was interviewed by the BBC and said “Apologies are not enough. I believe my cousin’s death was result of police incompetence.” He also stated that he believed his cousin had been “a victim of government’s mistakes”.

On Thursday the 22nd of March, 2005, Anna Ayala, a woman from Las Vegas, claimed to have found a human finger in her bowl of chili at a Wendy’s restaurant located at 1405 Monterey Highway, just south of downtown San Jose, California, owned by Fresno-based Jern Management.. The finger, which probably belonged to a woman as it had a long and manicured fingernail, did not belong to any of the restaurant employees. The food supplies were seized by officials to be traced back to its manufacturers, while the restaurant was permitted to open again later with chili prepared from fresh ingredients.

Wikinews reporter David Vasquez drove his car up to the drive-thru menu and found that chili was still on the menu, at a price of US$1.19 for a small serving. He also witnessed workers unloading supplies from a semi-trailer truck in the restaurant’s parking lot, and carting them into the back door of the establishment.

Initially, county health officials said Ayala was fine and the finger had been cooked, which would have killed any bacteriae in the finger. However, on March 27, officials admitted they were not so sure anymore. Tests were done on the finger to determine this. Dr. Martin Fenstersheib, Santa Clara County’s health officer, said that even if the finger was still raw when Ayala bit into it, the risk was low that she would have become infected with anything. However, he advised that Ayala should undergo a series of precautionary follow-up tests.

Sales at Wendy’s went down because of the incident. Wendy’s International, Inc. (WEN) closed at US$39.43 on Thursday the 22nd, and as the stock exchange was closed for the Good Friday holiday, traders did not weigh in the stock until the next Monday.

By Tuesday the 5th of April, officials had still not succeeded in tracking down the owner of the finger. The fingerprint on the detached digit has been run through an FBI database as well as the local criminal database in Santa Clara County, but no matches were found. According to Rich Reneau, who was leading the investigation at the time, the fingerprint was marginal, and the likelihood of finding a match was slim.

Wendy’s stock did not go down significantly and was trading at US$39.37 that morning.

The next day, on Wednesday the 6th, Las Vegas police searched the home of Anna Ayala. About a dozen officers conducted the search at Ayala’s home at Maryland Parkway and Serene Street at about 4 p.m. local time (23:00 UTC), according to witnesses at the scene. Ayala and other residents were handcuffed and brought out of the house. Ayala said that her teenage daughter, Genesis Reyes, had torn shoulder ligaments as a result of the search. The Las Vegas Review-Journal ran a photo of Reyes wearing a sling in their Friday edition. In San Jose, police spokeswoman Gina Tepoorten confirmed to reporters that investigators had served the warrant in cooperation with Las Vegas police on Wednesday, but she refused to reveal specific details about the warrant. By that time, Wendy’s was offering a US$50,000 reward for information leading to the source of the finger.

Research by the Associated Press uncovered Ayala’s history of lawsuits. Ayala successfully won her suit for medical expenses against the national El Pollo Loco chicken-chain, a previous employer, after her daughter Genesis contracted salmonella poisoning, allegedly from eating at the restaurant. However, Ayala lost another suit against General Motors in 2000 claiming that a wheel fell off her car. She also started a sexual harassment suit against her former boss in 1998. A total of 13 lawsuits in California and Nevada had been filed. Ayala replied the focus should be on Wendy’s, and not her record of law suits. Nick Muyo, a spokesman for the San Jose Police department, said not to expect new information in the case for at least a week.

On Wednesday the 13th there was a potential new lead in the investigation. A spotted leopard had torn off part of a finger from an owner of exotic animals, Sandy Allman, in Pahrump, Nevada. The portion of Allman’s torn off finger was approximately the same size – 1 1/2-inches long. Pahrump is approximately 45 miles away from Las Vegas. Carol Asvestas, who owns an exotic animal sanctuary, told the San Jose Mercury News she witnessed the leopard tear off the finger. She reported the incident to a hotline run by Wendy’s offering the US$50,000 reward. Cindy Carroccio told the San Jose Mercury News that the finger was not reattached, and that the clinic “gave it back to her (Allman) in a little bag of ice.” On the same day the lead was announced, Ayala decided to drop her lawsuit against Wendy’s, due to emotional stress.

However, when Allman’s prints were sent to San Jose police, they didn’t match. Two days later, on Friday the 15th, Wendy’s doubled the reward to US$100,000. The company revealed that employees had passed polygraph tests. Wendy’s continues to claim that there is no evidence that the finger ever entered their supply chain, pointing to a lack of any accidents among the workers at their suppliers. Wendy’s tip line had received reports from across the United States, from “folks who either have lost a finger, or know somebody who lost a finger,” San Jose police Sgt. Nick Muyo told the Associated Press.

On Thursday the 21st of April, Anna Ayala was arrested at or near her home in Las Vegas on Thursday evening, in connection with the case, shortly after Wendy’s finished its own internal investigation. According to court documents, she has been charged with one count of attempted grand larceny related to the chili case, and one count of grand larceny in an unrelated real estate deal, and is being held without bail in Clark County, Nevada, pending extradition. A press conference by the San Jose Police and Wendy’s was held on Friday, April 22, at 13:00 PDT. The charge related to the case states the finger could not have been prepared at Wendy’s, where the chili is heated to 170 degrees for 3 hours. There is also an inconsistency in Ayala’s account of finding the finger and claiming it caused her to vomit compared with police saying there was no vomit at the scene. The incident has caused Wendy’s 2.5 million dollars worth of damages, which Ayala could be criminally responsible for. Until recently, the San Jose police had not accused Ayala of planting the finger herself.

The unrelated charge stems from an incident, also in San Jose, when Ayala allegedly received an $11,000 down payment on a mobile home she did not own.

Ayala was incarcerated at the Clark County Detention Center, awaiting a fugitive review hearing on Tuesday, April 26, 2005, at 7:30 a.m. local time. She was processed and given inmate ID 01964047. Her case number was 05F07229X. Ayala waived extradition at the hearing, and her attorney said they were ready to come to San Jose to defend against the charges.

On Friday, May 6, 2005, Ayala was transported to San Jose, California. Ayala was booked into the main Santa Clara County jail, and is awaiting arraignment. Ayala will likely be arraigned on Monday or Tuesday at the Santa Clara County Superior Court, according to Santa Clara County Deputy District Attorney David Boyd.

On September 9, 2005, Ayala plead guilty to conspiring to file a false claim and attempted grand theft, and will be sentenced on November 2, 2005. She faces up to ten years in prison, and her husband faces up to 13 years behind bars.

Until the middle of May, the owner of the finger still had not been found.

But on May 13, 2005, police announced that they had identified the finger tip as belonging to an associate of Ayala’s husband [1]. The associate had lost his finger tip in an industrial accident at an asphalt company[2] in December, 2004. Police had received the information from an undisclosed caller to Wendy’s hot-line.

Man killed after shop robbery in West Yorkshire, England; murder investigation launched

A man has died after being involved in a robbery of his shop in West Yorkshire, England. Four youngsters, described as wearing hooded jumpers and tracksuit trousers, raided the Cowcliffe Convenience Store in the town of Huddersfield at approximately 2030 GMT on Saturday.

63-year-old Gurmail Singh sustained head injuries as a result of the robbery. Six witnesses attempted to prevent the youths from exiting the shop but failed, and the teenagers managed to escape with confectionary, cigarettes and money. One witness claimed to see a hammer in posession of one of the offenders, however it is unknown if this was used in the attack.

Singh was taken to Huddersfield Royal Infirmary but died there at approximately 0330 GMT on Sunday. West Yorkshire Police have now launched an investigation into the death of Gurmail Singh. A post-mortem examination is scheduled to take place on Monday to attempt to discover how the shop-owner was killed. West Yorkshire Police are now appealing for witnesses or anyone who has information in relation to this incident to contact them.
